What Are Your Rights?
If you have been caught breaking the law, or the police has reasonable suspicions of your involvement, you can be arrested. A warrant is not required in most cases, which means it is always in your best interest to conform to and follow directions quietly and calmly, as resisting arrest is a charge in itself.
While you may be arrested, you will always have certain legal rights that cannot be imposed on. The police can only hold you for questioning for a maximum of 8 hours and you always have the right to remain silent, after providing them with your name and address.
If the police wish to question you about a highly serious offence that can go to the higher courts, you have the right to contact a friend, relative or lawyer. The police must legally allow up to 2 hours for your contact to arrive. If you are located within Brisbane, you can reach our team on

What Courts Are There?
There are a wide range of courts within Queensland, so you will need to attend a specific court, depending on the seriousness of your case.
The Magistrate’s Court is the first level of the Queensland Courts system. Most criminal cases are first heard in a Magistrate’s Court, but primarily these consist of minor offences such as traffic infringements, shoplifting, burglary, fraud and assault.
For more serious crimes, including robbery, rape or dangerous driving, the case is first heard in the Magistrate’s Court, before being proceeded for sentencing within the District Court. This process is determined by a jury of 12 people and a judge. The Supreme Court follows a similar process, however it deals with the most serious criminal offences, including
major drug charges, murder and manslaughter.
