  • Induces any person to deliver property to any person
  • Gains a benefit or advantage, financially or otherwise
  • Causes a detriment, financially or otherwise 
  • Induces any person from doing an activity that they are lawfully entitled not to do
  • Induces any person from not doing an activity that they are lawfully entitled to do
  • Makes off, knowing payment was required or expected for a property or service, or purposefully avoided payment

What are the Penalties?

There are two types of fraud within Queensland, which will determine what penalty you may receive. Firstly, a fraud simpliciter is committed when a person engages in one or more of the conducts listed above. Once you have been charged, the Court will look at your past criminal history, the sophistication of the fraud and the total sum of money or other property involved. 


For first offenders and cases involving small amounts of property, a fine or a community-based order may be issued. The maximum penalty for fraud simpliciter, however, can go up to 5 years of imprisonment. 


Aggravated fraud is committed when a director, trustee or employee commits fraud against the corporation they are involved with. Any fraud that involves property or money that exceeds $30,000 is also automatically considered aggravated and can face up to 12 years of imprisonment.
